These terms govern your use of Sprout Saver. Please read them carefully before using our service.

1. Acceptance of Terms

By accessing or using Sprout Saver ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

If you are using the Service on behalf of a family, you represent that you have the authority to bind all family members to these Terms.

2. Description of Service

Sprout Saver is a virtual family bank application designed to teach children about financial literacy. The Service provides:

Important Notice

Sprout Saver does not handle real money transactions. All money tracked in the app is virtual and for educational purposes only. You are responsible for any real-world money exchanges with your children.

3. Account Registration

To use Sprout Saver, you must:

Be at least 18 years old (for parent accounts)
Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

Parental Responsibility: Parents are responsible for their children's use of the Service. You supervise and manage all children's accounts created under your parent account.

4. Subscription and Billing

Free Tier

Basic features at no cost:

4.1 Web Subscriptions

Web subscriptions are billed through Stripe. By subscribing on the web you agree to:

  • Pay the applicable monthly or annual fee disclosed at checkout.
  • Automatic renewal at the end of each billing period until you cancel.
  • A 30-day money-back guarantee for first-time subscribers (refund to the original payment method).
  • Receive at least 30 days' notice of any price change; increases do not apply to the current billing period.

Cancel at any time from Account Settings → Subscription. Cancellation takes effect at the end of the current billing period.

4.2 Apple App Store Subscriptions

When you subscribe through the Apple App Store, your subscription is sold by, billed by, and managed by Apple under Apple's Media Services Terms.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription in your Apple ID account settings after purchase, or online at apps.apple.com/account/subscriptions.
  • Refunds are handled by Apple according to Apple's policy. Request refunds at reportaproblem.apple.com.
  • Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription to that publication.
  • Family Sharing availability is controlled by Apple and may not be supported for all subscription tiers.

4.3 Google Play Store Subscriptions

When you subscribe through Google Play, your subscription is sold by, billed by, and managed by Google under the Google Play Terms of Service.

  • Payment is charged to your Google Play account on confirmation of purchase.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel at Google Play → Payments & subscriptions → Subscriptions, or on play.google.com.
  • Refunds are handled by Google Play according to Google's policy. Request refunds at play.google.com/store/account/subscriptions.

4.4 Store Billing Notice

If you subscribe in a mobile app, billing terms, trial availability, renewal timing, cancellation, and refund processing are controlled by your app store account, not Sprout Saver. We cannot process refunds for mobile app-store purchases directly.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Upload malicious code, viruses, or harmful content
  • Impersonate others or provide false information
  • Use the Service for commercial purposes without permission
  • Violate any applicable laws or regulations

6. Intellectual Property

Sprout Saver and its content, features, functionality, design, and branding are owned by us and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or create derivative works without permission
  • Use our trademarks without written consent
  • Reverse engineer or decompile our software

Your Content: You retain ownership of content you submit (chore descriptions, goal names, etc.). By submitting, you grant us a license to use, store, and display that content as needed to provide the Service.

7. Disclaimers

Service Provided "As Is"

Sprout Saver is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Educational Disclaimer

Sprout Saver is an educational tool and does not constitute financial advice. We are not licensed financial advisors. For actual financial decisions, please consult qualified professionals.

8. Limitation of Liability

To the maximum extent permitted by law, Sprout Saver and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to your account
  • Any errors or omissions in content
  • Any third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

By Us: We may terminate or suspend your account immediately, without prior notice, for violations of these Terms or for other reasons at our discretion.

By You: You may cancel your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. Data retention is governed by our Privacy Policy.

10. Dispute Resolution & Governing Law

10.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

10.2 Binding Arbitration

Subject to the opt-out right and small-claims carve-out below, you and Sprout Saver agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through individual, binding arbitration administered by JAMS under its Streamlined Arbitration Rules & Procedures then in effect. Arbitration will be conducted in English, seated in the State of California, and may be held by videoconference.

Class Action Waiver: You and Sprout Saver agree to bring claims only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.

10.3 Your Right to Opt Out of Arbitration

You may opt out of the arbitration agreement and class action waiver by sending a written opt-out notice within 30 days of first accepting these Terms. Send the notice to support@sproutsaver.com with subject line "Arbitration Opt-Out". Include your full name, the email address associated with your account, and a clear statement that you wish to opt out of §10.2. Opting out will not affect any other part of these Terms.

10.4 Small-Claims Exception

Either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction instead of arbitration.

10.5 Venue for Non-Arbitrated Claims

For any claim not subject to arbitration (including after a valid opt-out), you and Sprout Saver submit to the exclusive jurisdiction of the state and federal courts located in the State of California, and waive any objection to venue or forum non conveniens.

10.6 Severability

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

11. Changes to Terms

We may modify these Terms from time to time. Material changes will be announced via email to your account address or via an in-product notice at least 14 days before taking effect (or such longer period as applicable law requires). Non-material changes (clarifications, typo fixes, reorganizations) take effect when posted with an updated "Last updated" date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
